The Genetic Information Nondiscrimination Act of 2008 (GINA)

The Genetic Information Nondiscrimination Act of 2008 (GINA) is a Federal Law that will provide added discrimination protection for employees.

GINA prohibits employers with more than 15 employees from refusing to hire, promote, retain or otherwise discriminate against employees with respect to compensation or other terms or conditions of employment on the basis of their genetic health information.

GINA prohibits:

  1. group and individual health insurers from using a person’s genetic information in determining eligibility or premiums; or
  2. an insurer from requesting or requiring that a person have a genetic test; or
  3. employers from using a person’s genetic information in making decisions regarding hiring, firing, job assignments, and the like; or
  4. employers from requesting, requiring, or purchasing genetic information about persons or their family members.

The Genetic Information Nondiscrimination Act of 2008 (GINA) goes into effect November 21, 2009.
